Hello everyone,
just thought about doing logos for a race car and saw that a friend got a letter that a company wants him to delete their logo. So is there a high cance to get a copyright claim if i use and create a trademarked logo?

The short response - YES. If you are recreating any copyrighted logo of any company its their right to tell you to remove it. And legally they can pursue you if they want. Sucks but its a fact. Most real liveries have marketing licenses that are contractual. Hope that helps.
I also have never heard of some one getting a copyright notice.
I can say this though there is a local micro-brewery in my area and they had a cool logo, so I did it up on an Opel astra in FM4, I was happy with the results so just for fun I called their pr person and told her then directed her to my flickr page, as she scrolled down she commented on a cpl of my cars, then said. " Oh cool a crosswind pale ale car". I said ya I have sold like 15 or so in my Storefront. she got all quiet then, but I explained no real money was exchanged just in game credits. The next day I looked on their FB page and seen they had posted for everyone to see. Thought that was kinda cool. But they did have every right to tell me to pull it down and I would have had they asked.
The way I see it is this, yes they have the rights to send a cease and desist order to just about every painter in the game when it comes down to it. but on the other hand, A: the replica’s are all done by fans of theirs and d/l’ed by fans, and for the corporate logo’s heck they are getting free world wide advertising, and that can’t be a bad thing for them. Here in Canada Rogers, bell and Telus are the big 3 telco’s up here, I have been really tempted to make a design that could be considered disparaging to them. I could really see them taking action on that though so have refrained . honestly though that is the only time i can see a company or race team asking someone to remove a car. but that is only my opinion.
Now that I think of it I did tell her I was going to do a rock cut lager car for them to, guess I should get on that huh.

As far as has been the accepted procedure throughout the Forza Motorsport series, what is a “company logo” and so forth, previously was acceptable because it exists only with the game itself and does not actually get replicated for any commercial purposes outside the Forza/Xbox Live realm.
Better to get a full response from the folks who are a Microsoft Studios entity than take anyone’s word as legal advice on these forums.
