Is it possible to get a refund for a digital version?

I tried to get a refund for a digital game from Xbox/MS once.

It was well documented that the game was broken online and no-one could play it. They were ‘fixing’ it but it took too long and I lost interest.

When I contacted customer support they told me a straight no. I pushed it further and they said because the developer had acknowledged the issue they were allowed time to fix it so no refund could be given. When it still wasn’t working for me but had started to work for some others, not all, I phoned again and was told that if I contacted them again about the same issue my account would get flagged and would likely result in a ban from Xbox Live. Incredible customer support!

So now I just accept that refunds are impossible for digital content!

edit: I’ve had similar experiences with other non-digital items; if the manufacturer acknowledges the problem then getting a refund is near impossible. I’m still waiting for a repair or replacement of a white goods item 9 months after a well documented fault that could cause it to catch fire, yet because the manufacturer have said they will replace it (on a timescale to suit them) I am unable to get a refund. I was quoted extracts of consumer legal rubbish.

This sucks. I threw some legal works at them and they refunded me. But I agree, that if they acknowledge the problem you may be rightfully refused. Also, this may not be the nicest thing to do, but buy the same physical product from Amazon, and then place the broken one in and return it as broken. I started doing this to companies that have crap customer service and would take for ever to replace warrantied items. You also get a new item and not a refurb. And the best part is that Amazon doesn’t care, all costs fall back on the manufacturer.
